A Gilroy man who faces a second-degree murder charge in the death of a 4-year-old boy in June 2010 will wait at least two more weeks before entering a plea.

The plea hearing for James Francis Lee, 44, was rescheduled Thursday, for Jan. 20 at 2 p.m. at the Hall of Justice in San Jose.

The California Highway Patrol said Jose Cortes-Diaz was the victim of a drunken driving accident when Lee, driving home June 11 after a concert in Mountain View, slammed into the parked car of father Jesus Cortes-Diaz on the side of Highway 101 with his truck.
