Fllowers lay at the base of the pole where Ryan McFall was

Breanna Stewart faces an arraignment hearing June 26 after prosecutors recently charged her on suspicion of vehicular manslaughter in connection with the January traffic death of Ryan McFall, according to court records.

Stewart, 19 at the time of the Jan. 14 wreck at Union Road and San Benito Street, is scheduled for an arraignment at 8:30 a.m. June 26 before Judge Steven Sanders in room 101 of the courthouse. At arraignment, Stewart could offer her plea in the case.

The California Highway Patrol submitted its report March 23 to the district attorney in the January roadway death of Ryan McFall and recommended charges of driving under the influence and gross vehicular manslaughter against Stewart.

The district attorney’s office filed its charges May 24, according to records. Stewart did not have to be booked into the jail again after being bailed out in January, according to jail personnel.

A gross vehicular manslaughter conviction calls for a penalty of four, six or 10 years in prison, according to the penal code.

The CHP arrested Stewart after the 3 a.m. Jan. 13 wreck at Union Road and San Benito Street that killed 23-year-old McFall, a 2006 graduate of San Benito High School.

That morning at the accident scene, the CHP conducted field-sobriety tests on Stewart, who would be considered over the limit with any amount of alcohol in her system, and alleged she had been intoxicated. Stewart was arrested after a brief hospital visit and remains out on $100,000 bail.
