of a Morgan Hill couple accused of beating a pregnant woman back to
Jan. 8.
San Martin – New information in an assault case that has been delayed for several months has caused yet another continuance, moving the trial of a Morgan Hill couple accused of beating a pregnant woman back to Jan. 8.

Charles Peralta and Nicole Agriesti are free on $100,000 bail each.

The couple were in Santa Clara County Superior Court Monday, as their trial was expected to start, but Superior Court Judge Kenneth Shapero allowed the case to be continued in response to the defense’s request for additional preparation time. 

Deputy District Attorney Mark Hood said the defense has “new witnesses” and requested the continuance to complete further investigation of the case.

The two Morgan Hill residents are accused of assaulting 32-year-old Morgan Hill resident Xochitl Calderon after she kicked their car when they ran over her groceries. They also face a hate crime enhancement for yelling racial epithets while they attacked Calderon, according to witnesses.
