Former deputy sues department
San Jose – Retired Sheriff’s Sgt. Ted Atlas filed a lawsuit against county Sheriff Laurie Smith and the Santa Clara County Sheriff’s Office last week.
Atlas is a former sergeant for the K-9 division, and worked in the courts, jails, and on patrol for the agency for about 25 years.
The complaint seeks damages for wrongful termination, emotional distress, and breach of good faith and fair dealing. A jury trial has been requested.
According to the lawsuit, Atlas fell out of favor with the Sheriff when he testified in the “Scooby the Dog” issue in 2002.
The Scooby issue is in reference to a Sheriff’s handler who wanted to purchase a police K-9 after it bit a neighbor’s dog, instead of having it sent to the U.S. military. Scooby was removed from duty, and Atlas was removed from heading the unit.
According to the lawsuit, the manner in which Atlas was treated by the Sheriff and the department deteriorated dramatically forcing him to retire because of the hostile work environment.
He is being represented by the Law Offices of William D. Whiteman and Mark O. Rorem of San Francisco.
