• Gilroy – A 24-year-old San Jose man who was struck by a suspected drunken driver Saturday night died Tuesday morning, police said.

The man was driving east on Leavesley Road about 10:30pm when he was struck head-on by a van driven by Ruben Agular, 34, also of San Jose.

The victim suffered major injuries, including head trauma, and was flown to Stanford University Medical Center.

Agular was arrested on suspicion of felony driving under the influence and felony hit and run, but those charges could be amended to include a manslaughter charge, said Sgt. Kurt Svardal.

The case was turned over to the Santa Clara District Attorney’s office for review.

The identity of the victim was not available at press time.

152/156 funds OK’d by Senate

• Gilroy – A transportation bill that includes $13.9 million to reconfigure the intersection and build a flyover ramp for motorists traveling eastbound on Highway 152 across Highway 156 was approved Tuesday by the U.S. Senate. Known as the Transportation Equity Act, the bill was previously approved by U.S. Representatives.

The bill promises $295 billion for highway projects across the country. The money for the 152 flyover has also been promised by state officials, but federal funds would free up state money for other projects, including Highway 25 improvements.

DA will not seek fifth 4-year term

• San Jose – Santa Clara County District Attorney George Kennedy announced Monday he will not seek a fifth four-year term in office.

“I intend to vigorously complete my current term which ends the first Monday in 2007,” he said in a brief statement.

Kennedy, a 32-year veteran of the District Attorney’s office, first took office in December 1990 after holding most positions in the office, according to his biography on the office’s Web site.

20-year-old dies after fall from car

• Morgan Hill – An investigation continues into the death of Morgan Hill residents Edmond Mok, 20, during what appears to be horseplay gone wrong.

Mok jumped onto the hood of a 1995 Honda Civic driven by Samuel Flemming, 21, of Morgan Hill, Sampson said. They were on Piazza Way off West Edmundson Avenue, according to Morgan Hill Police Lt. Joe Sampson.

Witnesses said the car started moving or was moving when Mok jumped on it; Flemming braked, and Mok slide or fell off.

Mok was taken to Saint Louise Medical Center where he died at 6:51pm.

Flemming was not arrested, Sampson said, but the report will be sent to the District Attorney’s Office for review.

Boys planning vandalism cited

• Morgan Hill – Three Britton Middle School students were cited for conspiracy to commit arson and vandalism after officers investigating previous trash can fires turned up information about a planned disturbance on the last day of school.

The three eighth-grade boys – 13, 14 and 15 – were “in the process of coordinating a threat to damage school property,” including using pipe bombs, smoke bombs, stink bombs setting fire to garbage cans, and “toilet papering” restrooms at the school, police said.

Two of the students also were cited for arson in connection with an incident May 12 in which garbage can were set on fire.

The students were released to their parents.

Searches of the boys’ homes did not turn up materials used to make pipe bomb materials, but police did find items that indicated the youths were planning to ignite smoke and stink bombs.

Principal Russom Mesfun said the boys have been disciplined but declined to offer any details. He described the boys as good students who have not previously been in trouble.
