Lori McVicar, the convicted embezzler who abused her role as treasurer to funnel more than $50,000 from the Rod Kelley Elementary School parent club fund in 2001, received prison time, a new probation term and restitution plan at her Aug. 29 court hearing in San Jose, where McVicar admitted she was in violation of her probation.
She was originally sentenced to a new six-year, eight-month probation grant, but Judge Rene Navarro agreed to suspend three years and eight months of that probation since McVicar agreed to serve 45 days in jail, according to the Santa Clara County District Attorney’s Office. McVicar will be required to check in Friday evening and will be released Sunday evening until the 45 days are served.
McVicar was also ordered to make $200 monthly restitution payments until the entire $54,533.39 she stole from the school’s parent club is paid back in full. McVicar still owes approximately $15,000 to Rod Kelley Elementary.
McVicar, who was convicted of grand theft and forgery in 2002, was caught forging checks intended for scholastic items such as library books and playground equipment.
McVicar is required to make her restitution payments to the Santa Clara County Department of Revenue, which then disperses the money to Rod Kelley Elementary.
Past and present parent club and staff members from Rod Kelley have regularly attended McVicar’s numerous court proceedings, including principal Luis Carrillo and club member Christine West. They had feared McVicar’s probation would be terminated, a possible outcome that was debated, but the judge instead set the new terms.
McVicar’s next court date is Dec. 11 to review her case.
