Eluid Aguilar Hidalgo pleaded guilty to one felony count of assault with a deadly weapon and one misdemeanor count of brandishing a deadly weapon May 22 in a San Martin courtroom. Attorneys met Monday to schedule a sentencing hearing for 9 a.m. July 7.
The felony conviction holds a maximum sentence of four years in a correctional facility, Deputy District Attorney Frank Carrubba said. An added enhancement due to the bodily harm he inflicted on the victim could tack on an additional three years.
The district attorney’s office accepted Hidalgo’s plea with no conditions.
“Sometimes on cases with pretty serious injury, (the district attorney’s office) will not make a specific offer as to length of time of the sentence,” Carrubba said.
The adult probation department will present their recommended sentence at the hearing, Carrubba said. However, the judge has final discretion.
Hidalgo was arrested Feb. 2 after trying to kill his housemate at 791 Maria Way, police said. The victim lost the tip of his finger and sustained a large cut to his face, Carrubba said.
Both Hidalgo and the victim lived in a north Gilroy home that, at times, housed at least a dozen people, police and neighbors said. Police responded to a 911 call reporting a ruckus at the residence in early February. They found the victim in the front yard and Hidalgo hiding in the carport thanks to help from witnesses.
Police bandaged the victim’s head and hand and loaded him into an ambulance. The man – whose name police did not release – was taken to a San Jose hospital. Though police found the tip of the victim’s finger, doctors were not able to reattach it.
