A Gilroy man charged in the death of a 4-year-old boy in a July 2010 vehicle accident will face a trial beginning next month, according to the Santa Clara County Superior Court.

James Francis Lee, 44, faces charges including manslaughter and drunken driving after the California Highway Patrol said he crashed his vehicle into a parked car along U.S. Highway 101, killing Gilroy resident Jose Cortes-Diaz.

Lee’s case is set for 8:30 a.m. Tuesday, May 31, said Amy Cornell, media coordinator for the Santa Clara County District Attorney’s Office.

The case will appear on the court’s master calendar with others set to go to trial before it is transferred to another department in the Hall of Justice in downtown San Jose, where the trial officially will begin, Cornell said.

She said once the case arrives in the assigned trial room, the court will hear pre-trial motions before beginning its jury selection.

Lee has been charged with gross vehicular manslaughter, driving under the influence of alcohol and causing injury and driving with a 0.08 or higher blood alcohol content and causing injury, Cornell said.
