Settlement reached with Wells Fargo

SAN JOSE – The Santa Clara County District Attorney’s Consumer Protection Unit has reached a $25,000 settlement with Wells Fargo Home Mortgage Inc. in a civil lawsuit that alleged the company employed advertisements that did not comply with federal and state finance laws.

According to the DA’s office, federal and state statutes require certain loan terms – such as annual percentage rates (APRs) and the ability of variable rates to change in the future – be disclosed in a certain manner in advertisements.

The lawsuit alleged direct mailing flyers distributed by Wells Fargo Home Mortgage failed to include the terms, clearly state which advertised loans were fixed or variable rate and distinguish that some terms were limited only to certain classes or amounts of loans.

Wells Fargo Home Mortgage settled the suit without admitting wrongdoing or liability.
