Dear Editor:
Earlier this month, the California state legislature took an important step in the battle against spam, the flood of unsolicited bulk e-mail. The bill authored by Senator Kevin Murray was unanimously passed through the California Business and Professions committee.
This bill is supported by a cross-section of the industry including Yahoo, Microsoft and America Online because it gives Californians more tools to fight spam without placing unreasonable restrictions on technology companies.
Senator Murray’s bill adopts a reasonable tiered damage approach that gives consumers and businesses incentives to go after persistent spammers targeting legitimate companies with frivolous lawsuits. Legislation that creates litigation frenzy benefits nobody but trial lawyers. This bill places real restrictions on the purveyors of spam and makes sure they are held liable. For the benefit of Californians, it is important that this legislation is supported and pushed through the California Legislature this fall.
By supporting bills such as Senator Murray’s, which is tough on real problem spammers while protecting consumers and legitimate businesses, we can work together to create industry wide solutions.
