A judge postponed a plea hearing Friday for two men accused of having sex with a 13-year-old girl in an abandoned east Gilroy warehouse. Judge Ray Cunningham set the new hearing for local transient Jesus Hernandez and Gilroy resident Martin Gonzalez Lopez for Aug. 5.

Hernandez, 41, and Lopez, 43, were arrested May 6 on charges of committing lewd and lascivious acts with a child younger than 14 after allegedly having sex with the girl inside a former cannery building at 199 E. Ninth St. Hernandez also was arrested on a charge of sexual penetration with a foreign object of a child younger than 14.

The girl first met with about five people, most of whom were transients, at the abandoned warehouse about 7 p.m. May 4, according to police reports.

The girl said she told people at the warehouse that she was 18 years old, according to police. She asked if they had marijuana and methamphetamine, and they said they did, according to police reports. The girl told police that a man, who she later identified as Lopez, provided her with both drugs.

The girl told police that she had sex with Lopez, Hernandez and a third suspect, according to police reports.

Hernandez and Lopez both appeared calm as they sat together in court Friday. Both suspects, who appeared in brown jail-issued shirts, had shortly cropped hair during their recent court appearance.

The public defender’s office is representing Lopez, while an alternate defender is representing Hernandez. Both men are being held in Elmwood Correctional Facility in Milpitas on $50,000 bail.
