San Martin – Superior Court Judge Ray Cunningham deferred sentencing a 39-year-old Gilroy man who pleaded guilty to seven charges related too having sex with two 15-year-old girls. Instead, Cunningham ordered Robin Ofiana to undergo a psychological evaluation.
Before sentencing him Monday, Cunningham wanted to know whether Ofiana – who sobbed while pleading guilty April 9 – has been in control of his mind and emotions.
Deputy District Attorney Steven Dick appeared Monday on behalf of the people of Santa Clara County. He predicted the psych evaluation will take at least three weeks. When it is done, Ofiana’s sentencing will be rescheduled.
Ofiana faces up to eight years in state prison, according to Dick. Upon release, he would have to register as a sex offender for the rest of his life.
He has been in jail since his arrest on March 18 and must remain in custody during the psych evaluation, Dick said.
He pleaded guilty to three counts of performing a lewd act with someone 14 or 15 years old, three counts of unlawful sexual intercourse with someone under 16 and one count of annoying or molesting someone under 18. Before that, he had confessed the deeds to a city police detective.
Ofiana’s private defense attorney could not be reached for comment.
