Emilio is survived by his children ChrisMarie Rodriguez-Montez and Robert Emilio Rodriguez, and his grandchildren Sharlene Stokes, Kyle Stokes, Deven Rodriguez, and Lucas Rodriguez. He is also survived by his brothers and sisters; Juanita Alexander, Marcelo Rodriguez, Christine Chavez, Lydia Gonzales, Paul Rodriguez, Rudolpho Rodriguez, Reynaldo Rodriguez, David Rodriguez, Rene Rodriguez, Raul Rodriguez, Elodia Dixon, Veronica Gonzales, Carlos Rodriguez, and his stepmother Dolores Rodriguez.
 He is preceded in death by his parents Cruz Q. Rodriguez and Pablo Rodriguez, as well as his older brother Norbert Rodriguez.
 There will be a celebration of his life on Friday, October 12th, 2012, from 11:00 A.M. to 4:00 P.M. at the V.F.W Hall in San Juan Bautista.
