Police investigated a report of a bank robbery at Bank of America, 565 West Capitol Expressway in San Jose about 10:16 a.m. Dec. 28, according to a press release from San Jose police. The investigation revealed that Jose Luna, 21 of San Jose, and Steven Davis, 20 of Morgan Hill had concocted a plan to simulate a robbery.
Davis entered the bank, where Luna was working as a teller at the time, wearing sunglasses and a hooded shirt, police said. He presented Luna with a robbery demand note, and Luna gave Davis an undisclosed amount of cash from the bank.
Davis fled the scene and Luna reported to his co-workers and police that he had been robbed, police said.
Detectives approached the investigation as a legitimate robbery, with the assistance of Bank of America security personnel, the press release said. Bank staff provided information that led police to determine the robbery was planned by Luna and Davis.
Police arrested Luna during the investigation. Davis surrendered at the San Jose Police Department about 11:30 p.m. Dec. 28, with the cash he had stolen from the bank in his possession, police said.
