The 17-year-old Morgan Hill girl whose car struck and killed a Millbrae man Monday afternoon will not be charged, according to California Highway Patrol Officer Terrie Mayes.
William Francis Pene, 73, was changing a tire on the shoulder of Highway 101 just north of Coyote Creek Drive.
His truck, Mayes said, was parked 18-24 inches from the outside lane’s edge and part of his body was protruding into the roadway.
The girl, driving in the outside lane, was distracted by a bus driving next to her and told officers she did not see Pene, nor did she know what she hit.
”It was clear that he’s at fault,” Mayes said. ”But the girl was also inattentive and preoccupied.”
After the accident, the girl was taken to Saint Louise Regional Hospital in Gilroy and treated for severe emotional shock.
Mayes said Pene had pulled over to change his tire only 200-feet from a wide pull out built into the freeway for just such a purpose.
”If only people would realize you can drive for quite a while on those flat tires,” Mayes said. ”It’s just a rim and it’s not worth your life. Please, just get off the road.”
