Deputy’s lawyer says fatigue may have play role in crash
CUPERTINO
The lawyer for a Santa Clara County sheriff’s deputy who struck and killed two bicyclists says fatigue may have played a prominent role in the crash.
Mary Sansen says 27-year-old James Council doesn’t know exactly what happened when his squad car veered into the path of the small group of cyclists on a winding Cupertino road. She did say that those investigating the case may need to look at Council’s work schedule.
Council worked a 121⁄2-hour shift the day before Sunday’s crash and said fatigue may have been an issue.
Kristy Gough, of San Leandro and Matt Peterson, of San Francisco, were on a training ride with other cyclists when Council’s patrol car plowed into them.
A memorial service for Peterson is scheduled for 7 p.m. tonight in San Francisco.
SoCal teen angry over motorist sex proposition carjacks man’s car
VICTORVILLE
A 16-year-old boy angry over a motorist’s sex proposition on a Victorville street allegedly punched the man in the face and stole his car.
Terry Richardson was arrested for investigation of prostitution and the teenager was taken to juvenile hall for investigation of carjacking.
San Bernardino County sheriff’s spokeswoman Karen Hunt says the 22-year-old Richardson was behind the wheel of his Honda CRV when he pulled alongside the teenager Tuesday afternoon.
Richardson allegedly handed the youth a note soliciting sex acts. The youth then became enraged and punched Richardson, who ran from his car in fear.
Hunt says the boy then decided to get revenge, adding the teen’s attitude was, “I’m going to show him and I’m going to take his car.”
The teenager drove away and Richardson called deputies saying he was carjacked. The boy was pulled over minutes later and arrested.
SoCal man gets death for masterminding couple’s murder
LOS ANGELES
A Southern California man who arranged the murder of an elderly couple in La Habra Heights has been sentenced to death.
A Los Angeles judge on Thursday sentenced 55-year-old Theodore Shove while rejecting bids for a life sentence and a new trial.
An appeal is automatic.
Shove was convicted last fall of the first-degree murders of 81-year-old Hubert Souther and his 79-year-old wife. They were beaten to death in their bed in 2001.
Prosecutors said Shove arranged for another man to kill the couple so he could take over Souther’s aerospace salvage business.
Lewis Hardin was convicted of actually carrying out the tire-iron murder. He’ll be sentenced next month.

A security guard shot six times when gunmen opened fire from a car outside a Carson fast-food restaurant apparently wasn’t the target of the drive-by shooters.
