to the Santa Clara County District Attorney’s Office.
A Gilroy man facing charges in the death of a 4-year-old boy in a July 2010 automobile accident could face a jury trial, according to the Santa Clara County District Attorney’s Office.
During a Monday preliminary hearing, Santa Clara County Superior Court Judge Ron Del Pozzo ruled there was enough evidence to proceed with a trial against James Francis Lee, who was arrested on suspicion of drunken driving after the California Highway Patrol said he crashed his vehicle into a parked car along U.S. Highway 101, killing Jose Cortes-Diaz.
Lee faces charges of gross vehicular manslaughter, driving under the influence of alcohol and causing injury and driving with 0.08 or higher blood alcohol content and causing injury, said Amy Cornell, media coordinator for the district attorney’s office.
Lee’s next court date will be a 1:30 p.m. April 18 arraignment. After that hearing, a trial date will be set, Cornell said.
