Antonio Guerrero

Gilroy police on Saturday arrested a suspect from Milpitas who was wanted in the October 2011 shooting death of an 18-year-old man, according to a press release.

Officers arrested Antonio Guerrero, 19, at a home on Churchill Place in Gilroy Saturday afternoon following a report of domestic violence, according to the Gilroy Police Department.

A GPD media report states Guerrero allegedly struck his girlfriend over “Facebook posts.”

During the arrest, it was learned Guerrero was wanted by the Milpitas Police Department for the Oct. 15 homicide of David Benavidez, 18. Guerrero was taken into custody by Milpitas police and booked into the Santa Clara County Main Jail in San Jose on suspicion of homicide, police said.

Around 1 a.m. on Oct. 15, Milpitas police officers responded to reports of gunshots on the 500 block of Heath Street and “a person down” on the 400 block of Chestnut Avenue, police said. When officers arrived, they found Benavidez, who had suffered a gunshot wound. He was pronounced dead at the scene, police said.

In the days following the shooting, a Milpitas police investigation pointed to Guerrero as the suspect in the shooting, according to the press release. Detectives obtained an arrest warrant for Guerrero, but police had been unable to locate him until Saturday.

Anyone with information about the case should telephone the Milpitas Police Department at 408-586-2400. Those who wish to remain anonymous can telephone the Crime Tip Hotline at 408-586-2500.
