Police arrested a 55-year-old Gilroy resident Friday after he allegedly sexually assaulted a 13-year-old girl numerous times during a period of eight to 10 months.

Daniel Nicholas Alvarado, 55, of Broadway Street, was booked into Santa Clara County Jail without bail on charges of forcible rape, aggravated sexual assault of a victim under age 14, continuous sexual abuse of a victim under the age of 14, lewd or lascivious acts with a child under 14 by use of force or fear, and lewd or lascivious acts with someone 14 or 15 if someone is 10 years older than the victim.

“The victim was known to the suspect and had frequent access to her,” Sgt. Wes Stanford said.

The woman who called police had been involved in a domestic dispute with Alvarado on Friday morning and learned about the sexual assault in a conversation she had with the victim afterward, Stanford said.

She and the victim were with the suspect at Jack in the Box later that day when they locked themselves inside the restaurant’s bathroom, and the woman called police. The incident was reported as the rape of a child, Stanford said.

Alvarado is not a registered sex offender, Stanford said, and there is no indication he had been victimizing other children. However, he was on parole for robbery, Stanford said.

If convicted of a felony count, this could count as a his third strike, meaning that he could go to prison for life, a source close to the case said.

Alvarado grew up and lived in the Modesto area, and had recently been making trips to Newman, Los Banos and Turlock for personal reasons, the source said.
