Judge Harry Tobias today continued several considerations in the rape case of former sheriff’s Sgt. Mike Rodrigues at a court appearance where Deputy District Attorney Patrick Palacios, Defense Counsel Art Cantu and the suspect were present.

Rodrigues in December 2008 was indicted by a grand jury alleging three counts of forcible rape, two counts of unlawful sexual penetration and one count each of spousal rape, attempted rape and domestic violence. Authorities in September charged him with an additional rape count, along with felony charges for weapons and ammunition possession and misdemeanor violations of restraining orders.

The judge continued the matters against Rodrigues such as the need for transcripts to be provided from earlier preliminary hearings to the defense, and a necessary session between the judge and representatives from the sheriff’s office regarding a personnel records request.

Both sides also waived their rights to a speedy trial in the case.
