Anthony Hernandez, the Morgan Hill man accused of trying to kill his girlfriend’s father was in court Monday, but his hearing to announce a change of counsel was postponed.

Hernandez, 23 of Morgan Hill, stabbed Matt Benoit, 36, seven times in the back following an altercation April 29, according to police. The incident happened outside the Villa Teresa apartment complex on Berry Court in Morgan Hill, where Hernandez lived at the time.

He is charged with attempted murder, which carries a maximum sentence of life in prison if he is convicted. Hernandez remains in custody in lieu of $3 million bail.

Monday’s hearing was scheduled as an identification of counsel proceeding, as Hernandez will retain a new attorney, according to Santa Clara County District Attorney’s Office spokeswoman Amy Cornell. His attorney at the time of his not guilty plea in June was Ingo Brauer.

Since June, the court has conducted pre-trial proceedings to determine if there is enough evidence for the case to go to a jury trial.
