San Martin – Superior Court Judge Kenneth Shapero formally sentenced Gilroy resident Gerardo Ortiz Magaña, 21, to three years in prison for being accomplice to a stabbing on April 25, 2003 on East Eighth Street.

Shapero also ordered Magaña to pay a $600 fine, pay restitution to the victim and register with local police as a gang member after his release.

Magaña is a known Sureño gangster, and the victim belonged to a rival Norteño gang, prosecutor Stuart Scott has said.

Gilroy police never released the victim’s identity.

Witnesses said Magaña aided and abetted the assault, but it was a young man – possibly a juvenile – who wielded the knife, according to Scott.

About six people assaulted the victim outside the Pacheco Pass Motel, on East Eighth at Old Gilroy Street, Scott said.

Magaña was the only one arrested.
