Police were already suspicious of Martinez, stopped by an officer Sunday afternoon. At first, he claimed the girl was his cousin – but neither could name a common relative, police said. Then, as an officer clicked through Martinez’ phone, which Martinez volunteered to the officer, he found a three-minute video clip of Martinez having sex with a girl whose face couldn’t be seen. According to police, Martinez insisted the video was of another teen, a 19-year-old whose name he couldn’t remember.
Gilroy Detective Mitch Madruga picked up the case Monday and interviewed the 15-year-old girl and Martinez, who gave Madruga a name for the 19-year-old woman, and a handful of additional videos he said would prove that the cell-phone video was of her, not the 15-year-old. But the older teen’s tattoos belied Martinez’ claim, police said.
Eventually, Martinez confessed to the crime, and was arrested at 9:30am Wednesday for lewd acts with a child of 14 or 15 years, sodomy with a person younger than 16, and encouraging a minor to participate in a pornographic performance. He was booked into county jail and his bail was set at $200,000.
Police said the video files were too large to e-mail, and doubted that he was distributing them on a wider scale.
The Gilroy man had apparently been dating the girl for a month.
Martinez, a resident of 24822 Howell Lane, is scheduled to appear in court at noon today.
