– A 39-year-old local man has confessed to police that he had
sexual intercourse with two teen-age girls.
Robin Robert Ofiana has been charged with three counts of
performing a lewd act with a child age 14 or 15, three counts of
unlawful intercourse with a child under 16 and a charge of annoying
or molesting a child under 18, according to court records.
GILROY – A 39-year-old local man has confessed to police that he had sexual intercourse with two teen-age girls.
Robin Robert Ofiana has been charged with three counts of performing a lewd act with a child age 14 or 15, three counts of unlawful intercourse with a child under 16 and a charge of annoying or molesting a child under 18, according to court records.
He has been in Santa Clara County Jail since Thursday on $125,000 bail.
Gilroy police refused comment on the specifics of the case.
Ofiana told police he was extremely drunk during each of the sexual encounters with the girls, age 14 and 15 at the time, and Ofiana added that he was also high on cocaine for at least one of them. Both girls also told police Ofiana was drunk at the time. Ofiana entered an addiction rehabilitation program in early April 2002 and was sober for more than a year and a half, according to court records.
Ofiana and one of the girls gave nearly identical accounts of two incidents. In spring 2002, before he entered rehab, he had intercourse with her. Then, they both said, she refused his repeated requests for sex one night in late January of this year.
With the other girl, Ofiana described two encounters in which they had intercourse. The girl – whom a police detective interviewed on Feb. 26, the day after Ofiana’s confession – described two instances of sex in summer 2002. Asked about the second incident Ofiana described, the girl said she couldn’t remember. Each time, she said, she had been drinking with him and was intoxicated.
Ofiana has been a driver for a Morgan Hill market for five years, according to court records. His wife asked him to leave their Gilroy home earlier this year after hearing that he propositioned a girl in January, according to court records. After that, he lived out of a van and continued to work until his Thursday arrest.
Gilroy police first heard about the case on Feb. 24 and interviewed one of the girls on that date, according to the police report.
The next morning when a police detective came to work, he found several voice-mail messages from Ofiana asking to talk. The detective interviewed Ofiana over the phone and then in the police station that day. During this interview, the detective learned there was a second victim, whom he interviewed the next day.
The interview with Ofiana was voluntary, police reported – he said he wanted to confess – and he left the station afterward. Police told him they would let him know if or when a judge issued a warrant for his arrest.
Ofiana was taken into custody at 3:10 p.m. Thursday at the Gilroy police station. He was arraigned in court Friday, was referred to the public defender’s office and is scheduled to enter a plea Friday.
