Morgan Hill – A man facing felony charges of burglary and auto theft and a misdemeanor charge of possessing burglary tools delayed entering a plea last week when his hearing was continued to May 17.

Scott Campione, 41, of Turlock, remains in county jail in lieu of $15,000 bail after a Superior Court hearing in San Martin.

Campione was arrested April 24 after he was shot in the right bicep by Morgan Hill Police Officer Steve Pennington while allegedly fleeing from the scene of a burglary at the former Flying Lady restaurant on Foothill Avenue along the eastern foothills.

Pennington, who remains on paid administrative leave, told department superiors his weapon misfired. Three related investigations into the incident are ongoing. Chief Deputy District Attorney Karyn Sinunu said Friday, “MHPD did an absolutely fantastic job on this investigation, very thorough, very complete.”
