Although Gilroy is not a ‘sanctuary city’ police do not
investigate the citizenship status of anyone arrested and say that
it is a federal issue – just like all the politicians. I guess that
means if a bank is robbed (a federal crime) the local police just
let it go until a federal law enforcement officer arrives? That
would be the exact same reasoning!

“Although Gilroy is not a ‘sanctuary city’ police do not investigate the citizenship status of anyone arrested and say that it is a federal issue – just like all the politicians. I guess that means if a bank is robbed (a federal crime) the local police just let it go until a federal law enforcement officer arrives? That would be the exact same reasoning!”

Dear Frustrated with Reasoning,

Red Phone cannot change the way the police department operates or the way the department deals with the ones who are arrested.

So Red Phone contacted Sgt. Jim Gillio, spokesman for the Gilroy Police Department, who just said “In this caller’s example, bank robbery is a State of California offense as well as a federal offense, Penal code Section 211.”

Gillio said if anyone needs more information in this matter, he can contact him at 846-0347.

That probably does not alleviate much of your concern but if you continue to see a problem in the area, please let Red Phone know.

RV parking rules

“In Gilroy, is it legal to park an RV permanently in your driveway? What about putting an RV on your front lawn? There is a house located on the 8900 block of Iron Bark that, after having their RV parked in their driveway for two weeks, moved the RV to their front lawn where it has sat for three more weeks. We have called the city to ask for this to be resolved, but the RV is still there. While you’re at it, maybe you can get them to clean up the old carpet and trailer piled in their front yard. Property values are down enough already, so whatever you can do to help would be appreciated.”

Dear RV Blocking Your View,

It is understandable that homeowners in such an area would be concerned of eyesores such as a big RV in the yard, but whether or not the rules are being followed must first be established.

Code Enforcement Officer Scott Barron referred Red Phone to Gilroy Zoning Ordinance Section 33.30, which prohibits the parking of an RV or trailer on the lawn. However, it is allowed to be stored on the front yard area given that a few requirements are followed, such as it must be parked on a paved or approved driveway material, parked perpendicularly to the front curb and not extending at all over the public sidewalk.

Barron also encourages that since you are concerned about the status of a particular active enforcement case, you contact the department undertaking the action and speak to the officer himself.

“A short conversation may quickly allay their concerns,” he said.

With respect to the flag

“What do you do with old, faded or torn United States flags that you hang out in your yard? I know you can’t dispose of them only in certain places, so I would like to know what to do with them. Thank you.”

Dear Respectful of the Stripes and Stars,

It is great that you are aware of the how we need to be respectful of the country’s flag; everyone should know to act with that same attitude.

Red Phone again contacted Scott Barron, code enforcement officer, who said Veterans’ service organizations or the Boy Scouts or Girls Scouts are usually willing to properly handle the disposal of the flag.

Joe Kline, public information officer with the city, said there is a customer service counter at Nob Hill that offers a free ‘Flag Retirement’ service.

So, good caller, pay a trip to Nob Hill or call your local Boy or Girl Scout troop or a group similar to the American Legion and somebody will surely be able to help you out. Hope that helps to direct you.
