“I have a concern about the flea market and garage sale that appears every weekend at the intersection of Sixth Street and Stoney Court. Every weekend, you can find a full blown outdoor sale that includes appliances and clothing. I would like to know if there is an ordinance allowing for it.”
Red Phone: Dear Is It Allowed?, After following up with a complaint at this location several months ago, Code Enforcement Officer Scott Barron said he hasn’t received any further complaints from this residence since then.
The city does have an ordinance prohibiting a person from having flea-market type garage sales at a residence but doesn’t pro-actively enforce the policy because of limited personnel. But they will follow up on complaints they receive as time permits, Barron said.
 Garage sales can only be held once a year for a period of seven days (Gilroy Municipal Code 13.44). And a permit must be obtained from the city. People are limited to the hours of 8 a.m. and 8 p.m. The items for sale must be personal property owned by the resident for at least one year prior to the date of sale and not acquired for the purpose of resale.
